Terms & Conditions

These Terms & Conditions ("Terms") govern your use of the BP Snap mobile application (the "App") operated by Third Horizon Technologies Inc. ("we," "our," or "us"), a Canadian federal corporation.

By downloading, installing, or using BP Snap, you agree to these Terms. If you do not agree, do not use the App.

1. Eligibility & Age Requirements

You must be at least 13 years old to use BP Snap. If you are between 13 and the age of majority in your jurisdiction, you represent that your parent or legal guardian has reviewed and agreed to these Terms.

If you are under 13, do not use the App.

2. License to Use the App

We grant you a limited, non-exclusive, non-transferable, revocable license to use BP Snap for personal, non-commercial purposes, subject to these Terms.

You may NOT:

• Modify, reverse engineer, decompile, or disassemble the App
• Remove copyright, trademark, or other proprietary notices
• Use the App for any unlawful purpose
• Attempt to gain unauthorized access to our systems or services
• Use the App to provide services to third parties
• Scrape, crawl, or automate access to the App

3. License & App Store Terms

By installing or using BP Snap, you agree to these Terms of Use and the Apple Media Services Standard EULA, which governs the license to the iOS app. If there's a conflict between these Terms and the Standard EULA, these Terms apply to the maximum extent permitted by law.

4. Subscriptions & Payments

4.1 Subscription Plans

BP Snap offers optional paid subscriptions to unlock Pro features:

• Monthly: 1 month duration, automatically renews monthly
• Annual: 1 year duration, automatically renews annually

Current pricing is displayed in the App Store and within the App. Prices are in USD (or your local currency) and subject to change. Existing subscribers will be notified of price changes before renewal.

4.2 Billing & Auto-Renewal

Your Apple ID account is charged at the time of purchase. Subscriptions automatically renew unless you cancel at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.

4.3 Free Trials

We may offer free trials for certain subscription plans. Trial terms (duration, features included) are displayed at the time of sign-up and may vary.

If you do not cancel before your trial ends, you will be automatically charged for your selected subscription plan at the end of the trial period.

4.4 Managing Subscriptions

All subscriptions are managed through the Apple App Store. To manage or cancel, go to iOS Settings → [Your Name] → Subscriptions → BP Snap.

We cannot manage, cancel, or refund subscriptions directly—all billing is handled by Apple.

4.5 Refunds

All refunds for in-app purchases are handled by Apple according to their App Store refund policy. To request a refund:

• Visit reportaproblem.apple.com
• Sign in with your Apple ID
• Find your BP Snap purchase and request a refund

We do not control Apple's refund decisions. Generally, Apple allows refunds if requested within 14 days of purchase for valid reasons.

5. AI Photo Processing & Accuracy

BP Snap uses AI to read blood pressure monitor displays from photos. See our Privacy Policy for details on how photos are processed and deleted.

5.1 No Guarantee of Accuracy

AI-powered OCR is not perfect. While BP Snap is designed to accurately read blood pressure monitors, errors can occur due to:

• Poor lighting or glare on the monitor screen
• Blurry or out-of-focus photos
• Uncommon monitor display formats
• AI misinterpretation of digits

You are responsible for verifying that the detected values match your monitor before logging. BP Snap displays a confirmation screen showing the detected values—always check these before confirming.

5.2 Not a Substitute for Medical Devices

BP Snap does not measure blood pressure. It only logs readings from your FDA-cleared or medically validated blood pressure monitor. You are responsible for:

• Using a properly calibrated, accurate blood pressure monitor
• Following proper measurement technique
• Verifying logged values are correct

6. Ownership & Intellectual Property

6.1 Your Data

You own all blood pressure readings, notes, and health data you create in BP Snap. We do not claim ownership of your health information. You can export your data at any time as PDF or CSV files.

6.2 Our Intellectual Property

BP Snap, including its code, design, logo, and branding, is owned by Third Horizon Technologies Inc. You may not:

• Copy or redistribute the App
• Use our logo, name, or branding without permission
• Create derivative works based on BP Snap

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• We are not liable for any harm resulting from your use of BP Snap, including but not limited to:
  • Incorrect blood pressure readings caused by OCR errors
  • Medical decisions based on data logged in BP Snap
  • Service outages or downtime
  • Data loss (you are responsible for backups)
  • Reliance on trends, insights, or reports generated by the App
• Our total liability for any claim related to BP Snap will not exceed the amount you paid for your subscription in the 12 months prior to the claim (or $100, whichever is less).
• We are not liable for indirect, incidental, consequential, or punitive damages, including lost profits, lost data, or emotional distress.

This limitation applies even if we were advised of the possibility of such damages.

8. Disclaimers & No Warranties

BP Snap is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to:

• Warranties of merchantability or fitness for a particular purpose
• Accuracy, reliability, or completeness of data
• Uninterrupted or error-free operation
• Security or freedom from viruses

We do not guarantee that:

• The AI photo capture will always work correctly
• The App will be available 24/7 without downtime
• Your data will never be lost (you should back up important data)
• Third-party services (Apple Health, CloudKit, Gemini API) will always function

9. Service Availability & Changes

9.1 Right to Modify or Discontinue

We reserve the right to:

• Modify, suspend, or discontinue any feature of BP Snap at any time
• Update these Terms with 30 days' notice
• Change subscription pricing with 30 days' notice to existing subscribers

9.2 Service Outages

BP Snap relies on third-party services (Google Cloud, Apple iCloud, etc.). If these services experience outages:

• Photo capture may not work (you can still manually enter readings)
• CloudKit sync may be unavailable
• We are not liable for these outages

9.3 App Shutdown

If we discontinue BP Snap, we will:

• Provide at least 90 days' notice
• Allow you to export all your data
• Refund pro-rated subscription fees for Annual subscribers (not Lifetime)

10. User Obligations

By using BP Snap, you agree to:

• Provide accurate information: Enter or confirm BP readings accurately
• Use the App lawfully: Comply with all applicable laws and regulations
• Keep your account secure: If using CloudKit, protect your Apple ID credentials
• Not abuse the service: Do not attempt to hack, overload, or disrupt BP Snap
• Consult medical professionals: Always discuss your BP readings with your doctor
• Not misrepresent BP Snap: Do not claim it is a medical device or provides medical advice

11. Termination

11.1 Your Right to Stop Using BP Snap

You can stop using BP Snap at any time by:

• Uninstalling the App
• Canceling your subscription (in iOS Settings)

11.2 Our Right to Terminate Access

We reserve the right to suspend or terminate your access to BP Snap if you:

• Violate these Terms
• Engage in fraudulent activity (e.g., subscription abuse)
• Attempt to harm our systems or other users

If we terminate your access for cause, no refund will be provided.

12. Third-Party Services

BP Snap integrates with third-party services, each governed by their own terms:

• Apple HealthKit: Apple's Terms
• Apple CloudKit: iCloud Terms
• Google Cloud (Gemini API): Google Cloud Terms
• RevenueCat (subscription management): RevenueCat Terms

We are not responsible for the performance, availability, or policies of these third-party services.

13. Privacy

Your use of BP Snap is also governed by our Privacy Policy, which explains how we collect, use, and protect your data. Please read it carefully.

14. Indemnification

You agree to indemnify, defend, and hold harmless Third Horizon Technologies Inc., its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of BP Snap
• Your violation of these Terms
• Your violation of any third-party rights
• Medical decisions based on data logged in BP Snap

15. Dispute Resolution & Governing Law

15.1 Governing Law

These Terms are governed by the laws of the Province of Ontario, Canada, without regard to conflict of law principles.

15.2 Jurisdiction

Any disputes arising from these Terms or your use of BP Snap will be resolved in the courts of Ontario, Canada. You consent to the exclusive jurisdiction of these courts.

15.3 Informal Resolution First

Before filing any legal claim, you agree to first contact us at legal@bpsnap.app and attempt to resolve the dispute informally for at least 30 days.

16. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by:

• Posting the updated Terms in the App
• Updating the "Last Updated" date at the top
• Sending an in-app notification (for significant changes)

Your continued use of BP Snap after changes are posted constitutes your acceptance of the new Terms.

17. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

18. No Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

19. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Third Horizon Technologies Inc. regarding BP Snap and supersede any prior agreements.

20. Assignment

You may not assign or transfer these Terms or your rights under them. We may assign these Terms to any successor or affiliate without notice.
